6. Mobile Applications

6.1 App Store Distribution

Our mobile applications are distributed through Google Play Store and Apple App Store. Your use of the applications is subject to the respective store's terms and conditions in addition to these Terms.

6.2 App Updates

We may provide updates, upgrades, or modifications to our mobile applications from time to time. These updates may be automatically downloaded and installed. By using our applications, you consent to such automatic updates.

6.3 Device Requirements

You are responsible for ensuring your device meets the minimum requirements for our applications. We do not guarantee that applications will be compatible with all devices.

6.4 App Permissions

Our applications may request certain permissions to function properly. These permissions and their purposes are disclosed in the app's privacy policy and during installation.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEIJING XINQI TECHNOLOGY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR ANY COST OF COVER OR SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF OUR SERVICES, HOWEVER CAUSED AND UNDER WHATEVER THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Beijing Xinqi Technology and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of our services.

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of information as described in the Privacy Policy.

14. Age Restrictions and Children's Services

14.1 Minimum Age Requirement

You must be at least 13 years old (or 16 years old in certain jurisdictions such as the European Economic Area) to use our services. If you are under the age of majority in your jurisdiction, you represent that you have obtained parental or guardian consent.

14.2 Children's Applications

Applications designed for children comply with applicable children's privacy laws including COPPA (Children's Online Privacy Protection Act) and the UK Age Appropriate Design Code. These applications may have additional restrictions and requirements.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC).

16.3 Jurisdiction

For disputes that cannot be resolved through arbitration, you consent to the exclusive jurisdiction of the courts located in Beijing, China.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or through our applications. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.

18. Termination

18.1 Termination by You

You may terminate your use of our services at any time by discontinuing use and, where applicable, deleting your account.

18.2 Termination by Us

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

18.3 Effect of Termination

Upon termination, your right to use our services will cease immediately. Sections that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Beijing Xinqi Technology.

19.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
